Terms & conditions of use

You cannot login to the Fusion WiFi system without agreeing to these terms and conditions.

This is an agreement between you and FusionWiFi Ltd (Fusion WiFi) (“we” or “us”) who is responsible for delivering the WiFi access platform and in some cases the WiFi service.

These Terms and Conditions apply to the use of the Fusion WiFi service by You and maybe amended in the future.

FusionWiFi Ltd is registered in England & Wales.

1. Access To The Service
   
   
   1. Access to the Fusion WiFi service is free of charge but we may impose certain service restrictions including but not limited to the length of connection time available to you, bandwidth assignment, data usage. We reserve the right to terminate your access to our system at any time without prior notice to you.
   2. You are responsible for any charges incurred when accessing any subscription based websites or services when using Fusion WiFi and for all activities that occur on the service when using your username and password.
   3. You accept that we may restrict, or modify your service at any time to allow us to test the operation and performance of the service or to carry out scheduled or unscheduled network maintenance or technical repair work.



2. Hotspots & Devices
   
   
   1. To access the Fusion WiFi service your equipment must meet our minimum hardware and software requirements. Use of our service is dependent on the proper working of your equipment. You must have the explicit permission from the owner of the device (smart phone, tablet, laptop, pc) you are using to access this service with.
   2. Not all Fusion WiFi hotspots will be fully available all of the time and the bandwidth or quality of the service may very between venues.
   3. The service is intended for web browsing, basic email use, instant messaging, social media and the use of apps.
   4. You can only use the service when your device is in range of a Fusion WiFi network. The availability and performance is subject to the limitation of your device.
   5. We will not provide any software to you that relates to our service.
   6. If you choose to use any apps or software, then you accept the risk of any service failure that is a result of their use.
   7. You give us consent to Fusion WiFi collecting information about the device that you are using to access the service to allow us to make improvements or changes to our service offering in accordance with our Privacy Policy.



3. Your Obligations
   
   
   1. You do not use the service for anything illegal, immoral or improper.
   2. You have no ownership rights to any IP address. We maintain the right to revoke, deactivate or suspend any address without prior notice to you



4. Our Liability
   
   
   1. We have no liability to you other than what is set out in this agreement.
   2. Nothing in this agreement removes our liability for death or personal injury for any actions we failed to take.
   3. We are not liable for any losses to you.

Privacy Policy

1. Fusion WiFi acting as the data controller
   
   What information we collect about you:
   
   
   1. Your Details:
      When logging into our platform via social media channels we can collect information about you from the social media provider. This can include (but isn’t limited to) things such as your name, birthday, gender & email address.
   2. Your Devices:
      We record your device’s MAC address when you login, we link this to your social profile in our database to help us identify you as the user of that device.
   3. Locations:
      When you log into one of our hotspots we create a record that identifies you as having visited that location.



2. How your information is used:
   
   We (FusionWiFi Ltd) may use your data to contact you to help administer your account with us or to provide technical support to you as a user of our system. Your data will not be shared with any third-parties other than those venues that you have opted to receive marketing from, unless it falls under a legal obligation.



3. How your information is stored:
   
   We store all your information within secure datacentres, this in accordance with any applicable local law.



4. How long do you keep my information for?
   
   We will delete any data we hold on you if you haven’t used the service after 24 months of your latest login.



5. Fusion WiFi acting as the data processor
   
   

   When you have agreed to receive marketing communication from a venue, that venue will be given access to the information detailed in item 1.1. The venue has the ability to send you marketing communication (via email) from our platform as well as the ability to download the information provided to use within their own marketing tools. Any emails that are sent from our platform will always include the ability to opt-out from communication from that venue.

   If you send us a request to delete your data, we will send an automatic notification to that venue to let them know that you have asked us to delete the information that we hold on their behalf. If the venue has downloaded this information they will be acting in the capacity of a Data Controller and are responsible for the safe keeping and correct use of your information.




6. Accessing the information that we hold about you:
   
   You can request to see what information we hold on you by visiting the contact page on our website www.fusionwifi.com , or by sending an email to our data protection officer at dpo@fusionwifi.com from the email address that we have on file for you. Going through this process will allow you to amend what information we keep as well as what marketing communication you wish to receive from each of the locations that you have visited.
